These Terms of Service ("Terms") govern your access to and use of KM Academic Success, a service operated by KM Software Services Sdn. Bhd. (1308207-U) ("KM Academic Success", "we", "us" or "our"). By registering for, browsing, or using our platform — whether as a student, a tutor, or a visitor — you agree to be bound by these Terms. If you do not agree, please do not use the service.

KM Academic Success is a managed academic-success platform connecting university students (diploma through PhD) with live, 1-to-1 online tutors for real-time tutoring, academic coaching, and research support. Unlike a marketplace, we assess each student's needs and match them with a tutor ourselves — students do not browse or select tutors directly, and tutors do not advertise or solicit students independently of the platform.

You must be enrolled in, or a recent applicant to, a diploma, undergraduate, postgraduate, or doctoral programme to register as a student. Tutors must hold the qualifications they represent and pass our verification process before being approved to teach. You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential. You may not share your account or allow another person to use it.

New students are entitled to one complimentary 15-minute live demo session with a matched tutor before purchasing a package. Packages are sold by study level in tiers of 2, 4, or 8 sessions, each 60 minutes, delivered live and 1-to-1. Purchasing a package does not guarantee a specific tutor for every session; admin may assign or reassign a tutor based on availability and eligibility.

All tutor assignments — for demos and for package classes — are made by our admin team, based on the student's study level, field of study, and stated needs, and the tutor's qualifications and availability. A tutor may only be assigned to teach students at their own study level or below (for example, a tutor qualified at PhD level may teach PhD, postgraduate, and undergraduate students, while an undergraduate-qualified tutor may only teach undergraduate students).

All package fees are payable in full at the time of purchase through our checkout flow, via the payment methods offered at checkout. Prices are displayed in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless stated otherwise. We do not store your full card details; payments are processed through a secure payment channel.

Either the student or the tutor may submit a request to reschedule a demo or a package class, along with a reason and, optionally, a preferred new time. All reschedule requests are reviewed and must be approved by our admin team before the class time actually changes — a submitted request does not itself move the class. We ask that reschedule requests be made as early as possible and, where feasible, at least 24 hours before the scheduled class.

KM Academic Success exists to teach, guide, and coach — not to complete assessed work on a student's behalf. Tutors must not write, complete, or submit assignments, examinations, theses, or other assessed work for a student, and must not encourage or facilitate any form of academic misconduct. Students remain responsible for complying with their own institution's academic integrity policies.

All communication between students and tutors relating to a session — messages, questions, replies, and any attached files — is exchanged through the platform, which is reviewed by our admin team before being delivered to the recipient. Students only ever see a tutor's platform display name, and must not attempt to contact a tutor, or ask a tutor to be contacted, outside of the platform. Abusive, discriminatory, or harassing conduct toward any tutor, student, or staff member will result in suspension or termination of access.

Live sessions delivered through our platform may be recorded for quality assurance, dispute resolution, and the student's own revision purposes. By joining a session, you consent to it being recorded. Recordings are stored securely and are not shared with third parties except as described in our Privacy Policy.

All platform content — including our name, logo, course materials we author, and the software underlying the service — is owned by KM Software Services Sdn. Bhd. or its licensors. Materials a tutor prepares specifically for a student during tutoring remain available to that student for their personal, non-commercial study use, but may not be redistributed or resold.

We strive to provide reliable, high-quality tutoring, but we do not guarantee specific academic outcomes, grades, or results. To the fullest extent permitted by law, KM Software Services Sdn. Bhd. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, beyond the amount you paid for the relevant package.

We may suspend or terminate your account if you breach these Terms, including violations of our academic integrity, conduct, or privacy provisions. You may close your account at any time by contacting us; unused package sessions at the time of closure are handled under our Refund Policy.

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Malaysia.

We may update these Terms from time to time; material changes will be notified through the platform or by email. Continued use of the service after a change takes effect constitutes acceptance of the revised Terms. Questions about these Terms can be sent to info@kmacademicsuccess.com.
